Setting the Bar: Legal Approaches to Health Center Legal Compliance

Members of health center boards of directors have a legal duty under Section 330 of the Public Health Service Act (the law creating the Health Center Program) and other federal health care laws, including but not limited to Health Center Program requirements issued by Health Resources and Services Administration, to assure that the health center complies with all applicable laws and regulations. Congress has significantly increased penalties for noncompliance and federal agencies, including the Justice Department and the Internal Revenue Service, have stepped up their oversight activities.
Presenters will discuss areas of potential liability under federal health care and tax laws and explain the board’s role in reducing the risk of violations, including the important role that an effective corporate compliance program plays in protecting the board and the health center.
